General Terms and Conditions of Sale | Chakras Shop

1. Seller and Scope of Application

These general terms and conditions of sale govern sales concluded on the chakras-shop.com website between the company SAS MGLX (SAS with a share capital of €1,000, RCS Saint-Étienne 885 220 897, VAT FR01885220897, registered office: 2 impasse du Pré Vallée, 42480 La Fouillouse), hereinafter referred to as "the Seller", and any person placing an order as a consumer, hereinafter referred to as "the Customer". Placing an order implies acceptance of these terms and conditions.

2. Products

We sell natural stones, well-being items, incense, and accessories. Each product sheet describes the essential characteristics of the product. Stones and minerals are natural materials: their colour, shape, and veining vary from one piece to another, and the photographs are for illustrative purposes only. The virtues and symbolism mentioned are based on tradition; the products are not medical devices and do not replace the advice of a healthcare professional.

3. Prices

Prices are indicated in euros, all taxes included (VAT at 20%), excluding delivery charges. Delivery charges are specified in the basket before order confirmation: €6.90 up to 2 kg, €12.90 from 2 to 5 kg, and €14.90 from 5 to 30 kg, with free delivery from €59 of products. The Seller may change its prices at any time; the applicable price is that displayed at the time of the order.

4. Order

The order is registered after validation of the basket, delivery information, and payment. A confirmation email summarises the order. The Seller reserves the right to refuse or cancel an order in the event of an existing dispute, refused payment, undeliverable address, or unavailability of a product; the Customer will then be informed and fully refunded.

5. Payment

Payment is due at the time of order, by bank card or PayPal, via our secure payment service providers. We do not store any bank card data. The order is only processed after payment has been accepted.

6. Delivery

We deliver to home addresses in the following countries: France, Belgium, Luxembourg, Germany, Austria, Italy and Spain (excluding islands). Products are shipped from Europe, in a single tracked parcel per order. Delivery times, counted from dispatch, are as follows: France: 3 working days ; Belgium, Luxembourg and Spain (excluding islands): 3 to 4 working days ; Germany and Austria: 2 to 3 working days ; Italy: 4 working days. These times are indicative. In the event of a delay of more than 30 days compared to the announced date, the Customer may terminate the contract under the conditions of articles L.216-2 and L.216-3 of the Consumer Code. The risk of loss or damage is transferred to the Customer upon receipt of the parcel. In the event of a damaged or incomplete parcel, the Customer must make their reservations with the carrier and contact us within 72 hours.

7. Right of Withdrawal

In accordance with articles L.221-18 et seq. of the Consumer Code, the Customer has 14 days from receipt of their order to withdraw, without having to give any reason. To exercise this right, simply write to us at namaste@chakras-shop.com indicating your order number, or use the form below. The Customer must return the products, in their original condition, no later than 14 days after notifying their decision. The direct cost of returning the products is borne by the Customer. The Seller will refund all amounts paid, including standard delivery charges, no later than 14 days after receiving the products or proof of their dispatch, using the same means of payment. The right of withdrawal does not apply to sealed goods which cannot be returned for reasons of hygiene or health protection and which have been unsealed after delivery, nor to goods made to the Customer's specifications.

Model withdrawal form (to be sent to SAS MGLX, 2 impasse du Pré Vallée, 42480 La Fouillouse, or to namaste@chakras-shop.com): "I hereby notify you of my withdrawal from the contract for the sale of the following goods: order no. … placed on … received on …; name of customer: …; address of customer: …; date: …".

8. Statutory Guarantees

The Seller is bound by the statutory guarantee of conformity (articles L.217-3 et seq. of the Consumer Code, for 2 years from delivery of the goods) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). The Customer may exercise these rights by contacting us at namaste@chakras-shop.com.

10. Consumer Mediation

11. Personal Data

Data collected when placing an order is processed in accordance with our privacy policy.

12. Applicable Law

These terms and conditions are governed by French law. The consumer Customer benefits from the mandatory protective provisions of the country in which they reside.
